Court Vacates Atlantic Coast Pipeline Compressor Station Permit

Finds Virginia air board violated environmental justice principles

Today the U.S. Court of Appeals for the Fourth Circuit vacated the Virginia air permit for the proposed Buckingham Compressor Station in Union Hill, after a legal challenge filed by the Chesapeake Bay Foundation (CBF) with Southern Environmental Law Center and Friends of Buckingham.

CBF Vice President for Litigation Jon Mueller issued the following statement.

“This is a major win for clean air, clean water, and the people of Union Hill. But even more importantly, it’s also a major step forward for meaningful environmental justice. The Court has made clear that Virginia did not perform its legal duty to decide whether a major industrial facility in Union Hill would unfairly threaten the health of its vulnerable residents. That’s the crux of environmental justice.”
